Terms and Conditions of Service

Welcome to Hermetikon. Please read these Terms and Conditions ("Terms", "Terms of Service") carefully before using the Hermetikon website and service (the "Service") operated by Hermetikon ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, creating an account, or subscribing to a plan, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access the Service.

Your access to and use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy. Our Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your personal information when you use the Application or the Website and tells you about your privacy rights and how the law protects you. Please read our Privacy Policy carefully before using our Service.

2. Nature of Content & Assumption of Risk

The Service provides access to public domain texts and algorithmically generated analyses concerning occultism, alchemy, and esoteric history.

• 2.1 Educational Purpose Only: All content, including books, algorithmic responses, and RAG (Retrieval-Augmented Generation) citations, is provided strictly for historical, educational, and entertainment purposes. It is not intended as a manual for practice.
• 2.2 Dangerous Materials: You acknowledge that the historical texts contained in our database may describe the use of hazardous chemicals (e.g., mercury, lead, sulfur), dangerous physical acts, or psychological practices.
• 2.3 Waiver of Liability: You explicitly agree that Hermetikon shall not be liable for any physical injury, health problems, mental distress, property damage, or legal consequences resulting from your attempt to replicate, enact, or utilize any information, recipe, or ritual found within the Service or generated by our algorithms.
• 2.4 No Duty to Warn: Given the volume of historical text, Hermetikon has no obligation to flag, censor, or warn against specific dangerous content within the books or algorithmic outputs.

3. Algorithmic Services & Generations

Our Service utilizes computational language models (LLMs) to retrieve and synthesize information.

• 3.1 Probabilistic Nature: You acknowledge that these models are probabilistic and may "hallucinate" (generate false information). Hermetikon makes no representation or warranty regarding the accuracy, truthfulness, or safety of any automatically generated response.
• 3.2 Credit Usage & Errors:
  • Free Tier: Users receive 3 computational queries per month.
  • Paid Tier ($15): Users receive 75 computational queries per month.
  • Pro Tier ($49): Users receive 300 computational queries per month.
  • Consumption: A "request" is considered consumed the moment it is submitted to our server. If the system fails to respond, creates an error, produces gibberish, or times out, the credit is considered spent and will not be refunded or reinstated.
• 3.3 No Reliance: You agree not to rely on the algorithmic outputs for medical, legal, financial, or safety-critical advice.

4. Prohibited Uses

You agree to use the Service only for lawful purposes and in accordance with these Terms. You explicitly agree NOT to:

• 4.1 Violate Laws: Use the Service in any way that violates applicable national or international laws or regulations, or to promote any illegal activity.
• 4.2 Reverse Engineering: Attempt to decompile, reverse engineer, disassemble, or derive the source code or underlying algorithms of the Service or our computational models.
• 4.3 Automation & Scraping: Use any robot, spider, scraper, or other automated means to access the Service or extract data (including text, images, or algorithmic generations) for any purpose without our express written permission.
• 4.4 Account Sharing: Share your account credentials with anyone else. Your subscription is personal to you.
• 4.5 Algorithmic Manipulation: Attempt to "jailbreak," manipulate, or exploit the system to generate content that violates our safety guidelines, creates malware, or circumvents our content filters.
• 4.6 Harmful Usage: Use the Service to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

5. User Content & Intellectual Property (Data Ownership)

This section defines who owns the notes, prompts, and data you generate. Read this carefully.

• 5.1 Assignment of Rights: By creating notes, submitting prompts, saving chats, or generating data within Hermetikon ("User Content"), you hereby irrevocably assign and transfer to Hermetikon all right, title, and interest in and to such User Content, including all intellectual property rights therein.
• 5.2 License Fallback: If the assignment in Section 5.1 is deemed invalid by a court of competent jurisdiction, you hereby grant Hermetikon a perpetual, irrevocable, worldwide, royalty-free, exclusive, transferable, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content for any purpose, including but not limited to training machine learning models, improving the Service, and commercial usage.
• 5.3 Data Retention & Anonymization: You acknowledge that your User Content is used to train and improve our computational models. Upon deletion of your account or specific notes, Hermetikon will permanently anonymize your User Content by stripping it of all direct personal identifiers. You agree that Hermetikon may retain this Anonymized Data indefinitely for machine learning and analytical purposes. Once anonymized, this data is no longer considered Personal Data under GDPR, and it becomes the sole property of Hermetikon.

6. Subscriptions, Payments, and No Refunds

• 6.1 Billing: Paid subscriptions are billed in advance on a monthly basis.
• 6.2 No Refunds: All payments are non-refundable. There are no refunds or credits for partially used periods, unused computational queries, dissatisfaction with the Service, or Service downtime. By subscribing to the Service, you request immediate access to the digital content. You explicitly acknowledge that you thereby lose your EU Right of Withdrawal (14-day cooling-off period) once the subscription is active and digital content/credits have been delivered.
• 6.3 Use It or Lose It: Unused query credits do not roll over to the next month. They expire at the end of your billing cycle.
• 6.4 Price Changes: We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Price changes will take effect at the start of the next subscription period following the date of the price change. We will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to terminate your subscription before such change becomes effective.

7. Termination

• 7.1 Termination: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever. If we terminate your account for a breach of these Terms, no refund will be issued. If we terminate your account without cause, we will refund a prorated portion of your subscription fee for the unused period.
• 7.2 Effect of Termination: Upon termination, your right to use the Service will immediately cease.
• 7.3 No Data Export: Upon termination (whether by you or us), Hermetikon is under no obligation to provide you with a copy of your notes, history, or User Content. We retain the rights to use your data as defined in Section 5.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HERMETIKON, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

UNDER NO CIRCUMSTANCES WILL HERMETIKON BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT.

TOTAL LIABILITY OF HERMETIKON FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE LAST ONE MONTH (OR $100 IF YOU ARE A FREE USER).

9. Indemnification

You agree to defend, indemnify and hold harmless Hermetikon and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) any physical or mental injury resulting from your application of the content found within the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
